These Terms of Service ("Terms") govern your access to and use of hueandqueue.com and the connected Hue & Queue network, including Cassowary Recordings, Paint & Hope Studio, The Loot & Greed Syndicate, the shared Video Hub, memberships, accounts, community features, stores, media and related services.
By using Hue & Queue, creating an account or purchasing a product or service, you agree to these Terms and any additional terms clearly presented for the relevant product, membership, event or service.
1. About Hue & Queue
--------------------
Hue & Queue is an independent creative network operated from South Australia, Australia. It connects music, visual art, stories, gaming/world projects, video, community features and related products and services under one account and platform.
2. Eligibility and accounts
---------------------------
You must provide accurate information when creating or maintaining an account. You are responsible for keeping your login details secure and for activity performed through your account unless the activity resulted from a security failure for which you are not responsible.
You may sign in using a native Hue & Queue account or an enabled third-party provider such as Google or Facebook. Use of an external sign-in provider is also subject to that provider's terms. External sign-in is optional and native account access remains available.
3. Younger users, classifications and age-restricted material
-------------------------------------------------------------
Hue & Queue may carry material intended for different audiences, including gaming, livestream, video, story and artwork content. Where a classification, age restriction or audience notice is shown, you must meet that requirement to access the material.
R 18+ material is for adults only. You must be at least 18 years old to access areas that Hue & Queue identifies as R 18+ or otherwise legally restricted to adults. MA 15+ and other restricted content must be handled consistently with the applicable Australian classification rules. Hue & Queue may use age gates or other age-assurance measures and may deny or remove access where age requirements are not met.
Nothing on Hue & Queue permits content that is unlawful, Refused Classification (RC), exploitative or otherwise prohibited. A label such as "18+" does not make otherwise unlawful material acceptable.
4. Memberships, subscriptions and early access
----------------------------------------------
Hue & Queue may offer free or paid memberships, subscriptions, supporter benefits, early access, member-only media or other account benefits. The price, billing interval, renewal terms, included benefits and cancellation method for a paid offering will be shown before purchase or activation.
Early-access or member-only content may later become public, be changed, rescheduled or withdrawn. Purchasing a membership does not transfer ownership of copyright or other intellectual-property rights in the content.
5. Prices, GST and payment
--------------------------
Prices are shown in the currency stated at checkout or on the relevant product page. Where required, applicable taxes or GST will be included or disclosed in accordance with law. You authorise the configured payment provider to process amounts you approve at checkout.
We may correct an obvious pricing or technical error before fulfilment. If payment has already been taken for an item affected by an error and we cannot reasonably fulfil the transaction at the displayed terms, we will provide an appropriate refund or other remedy required by law.
6. Physical goods
-----------------
When physical goods are offered, product descriptions, availability and estimated dispatch or delivery information are provided in good faith. Images may vary slightly from the delivered item because of screens, handmade processes, materials, manufacturing tolerances or packaging updates.
Shipping, returns and refund information is set out in our Shipping, Returns & Refunds Policy (https://hueandqueue.com/shipping-returns/) .
7. Original artwork, custom orders and commissions
--------------------------------------------------
Paint & Hope Studio and other Hue & Queue businesses may offer original artwork, made-to-order pieces and commissioned work. A commission becomes binding when the customer accepts the written quote or order form and pays any required deposit or first instalment.
The commission form or quote should record the agreed size, medium, subject, reference material, price, deposit, expected timeframe, delivery method, included revision or approval stages and any special requirements. Changes requested after approval may require a revised price or delivery estimate.
Change of mind: because commissioned and made-to-order artwork is created for a particular customer, Hue & Queue does not offer a change-of-mind refund once work has commenced or an agreed approval stage has been passed, unless we expressly agree otherwise. If a customer cancels before completion, amounts already paid may be applied to work already performed, materials ordered or used, and other reasonable loss directly caused by the cancellation. We will not rely on this clause to remove rights that cannot legally be excluded.
Approval: where progress proofs, sketches or approval photographs are supplied, the customer is responsible for reviewing them carefully and raising requested changes within the stated approval period. Approval does not remove rights relating to faults, major departures from the agreed description, or other non-excludable consumer guarantees.
Handmade variation: original and hand-painted work can include natural variation in brushwork, texture, colour, materials and finish. Screen displays and photographs can also reproduce colour differently. These normal variations are not defects where the delivered work otherwise matches the agreed description and quality.
Reference material and permissions: customers who provide photographs, logos, characters, text or other reference material for a commission confirm that they have the rights and permissions needed for us to use that material for the commissioned work. For portraits or likenesses of another person, the customer must obtain any consent reasonably required, especially where a child is depicted.
Copyright: purchase of a physical artwork normally transfers ownership of that physical object only. Copyright and reproduction rights remain with the artist or relevant rights holder unless a separate written assignment or licence says otherwise. Commercial reproduction, merchandising, scanning for resale, or use as a logo or brand asset requires written permission unless already included in the commission agreement.
Additional commission-specific terms are set out in the Custom Artwork & Commission Terms (https://hueandqueue.com/commission-terms/) .
9. Digital content and access
-----------------------------
Digital products, streams, downloads or member-access features are licensed for the use described at the time of purchase or access. Unless expressly stated otherwise, you may not redistribute, resell, publicly perform, reproduce, scrape or commercially exploit digital content beyond rights granted by law or a specific licence.
Streaming or access features may depend on your device, browser, internet connection, account status and third-party infrastructure.
9. Gaming, livestreams, recordings and chat
-------------------------------------------
Gaming and livestream content may include strong language, violence, horror, gambling themes, drug references or other mature material. Any official classification marking or consumer advice must reflect the applicable classification of the relevant content; Hue & Queue will not treat every gaming stream as automatically R 18+ simply because it is intended for adults.
Where a stream or recording contains material that is R 18+, otherwise legally restricted, or assessed by Hue & Queue as requiring an adult audience, access may be limited to verified adults and preview imagery, autoplay and discovery surfaces may be restricted.
Livestreams may be recorded, clipped, archived, captioned, translated or republished on Hue & Queue. If you participate in a live chat, voice channel, multiplayer session or other interactive feature, your display name, messages, voice or contribution may appear in the resulting recording where the feature clearly indicates that recording is occurring. Do not disclose private information in public chat.
Streamers, moderators and users must follow the Community, Streaming & Age Rules (https://hueandqueue.com/community-safety/) , applicable game/platform terms, intellectual-property rules and Australian law.
10. Pre-orders, scheduled releases and events
---------------------------------------------
Pre-order, premiere, early-access and event dates are estimates unless expressly guaranteed. Creative projects, releases and events can change. If a paid product or service is materially changed or cannot be supplied, we will provide the remedy required by applicable law and any additional remedy stated for that offering.
10. Australian Consumer Law
---------------------------
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
If goods or services have a problem covered by a consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation, re-supply or compensation depending on the circumstances and seriousness of the problem.
11. Change-of-mind returns
--------------------------
Australian Consumer Law does not generally require a business to provide a refund simply because a customer changes their mind. Where Hue & Queue offers a voluntary change-of-mind return for a particular product, the conditions will be stated on the product page, at checkout or in the Shipping, Returns & Refunds Policy (https://hueandqueue.com/shipping-returns/) . Those voluntary conditions do not limit rights for faulty or non-compliant goods or services.
12. User content
----------------
If you submit comments, profile material, reviews, messages, artwork, text, media or other content to a feature that accepts user content, you retain any rights you already own. You give Hue & Queue a non-exclusive licence to host, reproduce, format, display and technically process that content only as reasonably necessary to operate, secure, moderate and provide the relevant feature.
You must have the rights necessary to submit the content and must not upload material that unlawfully infringes another person's intellectual property, privacy or other rights.
13. Community standards and moderation
--------------------------------------
You must not post or transmit unlawful, threatening, harassing, hateful, defamatory, privacy-invasive, fraudulent, malicious, sexually exploitative, infringing or spam content. Do not impersonate another person, falsely claim an affiliation, or deliberately mislead users about the source of content.
We may remove, restrict, label, preserve, investigate or report content where reasonably necessary to enforce these Terms, protect users, comply with law or maintain the integrity and security of the service.
14. Prohibited conduct
----------------------
You must not:
- break applicable law or encourage unlawful conduct;
- infringe copyright, trade marks, privacy, publicity or other rights;
- attempt to obtain unauthorised access to accounts, systems or non-public information;
- introduce malware or intentionally interfere with security, availability or performance;
- circumvent access controls, membership restrictions or security measures;
- use the service for phishing, credential theft, fraud, scams or spam;
- automatically scrape or harvest the service in a manner that materially burdens the platform or bypasses controls, except where expressly permitted; or
- use Hue & Queue content or user data in a way that violates copyright, privacy rights, contractual restrictions or applicable law.
15. Intellectual property
-------------------------
Unless stated otherwise, Hue & Queue and its licensors own or control the website design, branding, logos, software, original music, sound recordings, artwork, photography, stories, video, text, graphics, metadata and other content made available through the service.
No ownership rights are transferred merely because content is accessible through the website. Any licence granted for a product or item is limited to the rights expressly stated with that content or required by law.
16. Copyright and rights complaints
-----------------------------------
If you believe material on Hue & Queue infringes your copyright, trade mark, privacy or other rights, contact us through the Contact page (https://hueandqueue.com/contact/) and provide enough information to identify the work, the relevant material, your contact details and the basis of the complaint.
17. Third-party services and external links
-------------------------------------------
Hue & Queue may integrate with or link to services operated by Google, Meta/Facebook, Zoho, Stripe, Cloudflare, streaming services, social networks, stores or other providers. Third-party services are controlled by their respective providers and their own terms, policies, outages and availability rules apply.
18. Automated, AI and translation features
------------------------------------------
Some features may use automated transcription, translation, recommendations, summaries, moderation assistance or artificial-intelligence tools. Automated output may contain errors or omissions and should not be treated as an authoritative statement of price, legal rights, order status, release date, policy or contractual commitment unless confirmed by the relevant Hue & Queue source.
19. Availability and maintenance
--------------------------------
We aim to keep Hue & Queue available and reliable, but websites and online services may experience maintenance, faults, provider outages, internet failures, cyber incidents or events outside reasonable control. We do not promise uninterrupted or error-free operation.
We may modify, replace or discontinue free features. If a material change affects a paid service, your non-excludable consumer rights and any specific purchase terms continue to apply.
20. Security
------------
You must not test, probe or attempt to defeat security controls without written permission. If you discover a suspected security vulnerability, please report it privately through the Contact page (https://hueandqueue.com/contact/) rather than exploiting or publicly disclosing it in a way that creates avoidable risk.
21. Suspension and termination
------------------------------
We may suspend or restrict an account where reasonably necessary to protect users, prevent fraud or abuse, investigate security issues, comply with law or address a serious or repeated breach of these Terms. Where appropriate, we may provide notice or an opportunity to resolve the issue.
You may stop using Hue & Queue at any time. Account deletion may be requested subject to lawful retention of transaction, security, dispute, tax and backup records.
22. Disclaimers and liability
-----------------------------
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including non-excludable rights under the Australian Consumer Law.
To the extent permitted by law, free website features are provided on an "as available" basis. Creative, editorial, recommendation, community, translation and automated features may contain errors. Hue & Queue is not responsible for indirect or consequential loss to the extent such liability may lawfully be limited.
23. Privacy
-----------
Our handling of personal information is described in the Hue & Queue Privacy Policy (https://hueandqueue.com/privacy/) .
24. Changes to these Terms
--------------------------
We may update these Terms when services, business practices or legal obligations change. The current version will be published at https://hueandqueue.com/terms/ with a revised "Last updated" date. Material changes affecting an existing paid service will be handled consistently with applicable law.
25. Governing law
-----------------
These Terms are governed by the laws of South Australia and the Commonwealth of Australia, subject to any mandatory consumer or other law that applies to you and cannot lawfully be excluded.
26. Contact
-----------
Questions about these Terms, purchases, memberships, rights complaints or the service can be sent through the public Hue & Queue Contact page (https://hueandqueue.com/contact/) .
